1. Introduction
Welcome to bh-labs.com (the “Site”), operated by BH-Labs, LLC, a Florida limited liability company (“BH-Labs,” “we,” “us,” or “our”). These Terms of Use (“Terms”) govern your access to and use of the Site and any content, features, or services made available through it (collectively, the “Services”).
By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Site.
These Terms do not govern the purchase of equipment, installation, training, or support services from BH-Labs. Those are governed by BH-Labs’ separate Terms and Conditions of Sale, which are provided with each quote, proposal, or invoice.
2. Eligibility
You must be at least 18 years old to use the Site. By using the Site, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.
3. Nature of the Site; No Medical Advice
BH-Labs supplies, installs, and supports recovery and wellness equipment for commercial operators, including hotels, fitness and sports clubs, clinics and wellness businesses, universities, and residential communities as well as individual users. The Site is provided for informational and marketing purposes only.
Content on the Site describing recovery modalities, including hyperbaric oxygen therapy, red light therapy, pulsed electromagnetic field therapy, infrared sauna, compression therapy, and lymphatic drainage, is not medical advice and is not a substitute for consultation with a licensed healthcare provider. BH-Labs does not provide medical services, does not diagnose, treat, cure, or prevent any disease, and makes no representation about outcomes for any individual user of equipment it supplies. Operators who purchase equipment from BH-Labs are solely responsible for compliance with the laws and regulations applicable to their own facilities and services.
Revenue figures, projections, and calculator outputs shown on the Site are illustrative examples based on stated assumptions. They are not forecasts, guarantees, or promises of results for any property.
4. Accounts and Submissions
Certain features of the Site (such as contact forms, revenue projection requests, or scheduling a call) may require you to submit personal or business information. You are responsible for providing accurate, current, and complete information.
If you submit any content, feedback, questions, suggestions, or ideas to us through the Site or otherwise (“Submissions”), you grant BH-Labs a worldwide, perpetual, irrevocable, royalty-free license to use, reproduce, modify, and distribute the Submissions for any purpose without compensation to you. Do not submit anything you consider confidential or proprietary.

“BH-Labs,” “BH Labs,” the BH Labs mark, and related marks are trademarks of BH-Labs, LLC. You may not use them without our prior written permission. Names of third-party venues, operators, and brands that appear on the Site are the property of their respective owners and are used to identify reference installations only; no endorsement is implied.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site for informational purposes in connection with evaluating BH-Labs’ products and services. All rights not expressly granted are reserved.
7. Third-Party Links and Services
The Site may contain links to third-party websites, services, or resources, including scheduling tools and reference customers’ sites. BH-Labs does not control and is not responsible for the content, policies, or practices of any third parties. Your use of any third-party site is at your own risk and subject to that third party’s terms and policies.

THE SITE AND ALL CONTENT AND SERVICES PROVIDED THROUGH IT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. BH-LABS DISCLAIMS ALL WARRANTIES, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED USE.
BH-LABS DOES NOT WARRANT THAT THE SITE WILL BE ERROR-FREE, SECURE, OR CONTINUOUSLY AVAILABLE, OR THAT ANY CONTENT IS ACCURATE, COMPLETE, OR CURRENT.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, BH-LABS AND ITS OFFICERS, MANAGERS, MEMBERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SITE.
BH-LABS’ TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100.00).
Some jurisdictions do not allow the exclusion or limitation of certain damages; in such jurisdictions, our liability is limited to the maximum extent permitted by law.
10. Indemnification
You agree to defend, indemnify, and hold harmless BH-Labs and its officers, managers, members, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with (a) your access to or use of the Site, (b) your violation of these Terms, or (c) your violation of any rights of another.
11. Governing Law; Dispute Resolution
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law principles.
Any dispute arising out of or relating to these Terms or the Site shall be resolved by binding arbitration administered by the American Arbitration Association (“AAA”) under its Commercial Arbitration Rules, seated in Broward County, Florida. Judgment on the award may be entered in any court of competent jurisdiction.
YOU AND BH-LABS WAIVE THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO PARTICIPATE IN ANY CLASS ACTION OR CLASS ARBITRATION.
Notwithstanding the foregoing, either party may bring an individual action in small claims court, or seek injunctive or equitable relief in any court of competent jurisdiction for infringement of intellectual property rights.
12. Changes to the Terms
We may modify these Terms at any time. Changes take effect when posted on the Site. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
13. Termination
We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including violation of these Terms. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) shall survive.
14. Miscellaneous
Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and BH-Labs regarding the Site and supersede all prior agreements and understandings regarding the Site.
Severability. If any provision is held unenforceable, the remaining provisions will remain in full force and effect.
No Waiver. BH-Labs’ failure to enforce any provision is not a waiver of that provision.
Assignment. You may not assign or transfer these Terms without our prior written consent. BH-Labs may assign these Terms freely.
